II. BACKGROUND GridPIus is authorized by the Commission to provide retail electric service under REP Certificate No. 10256. On information and belief, on April 19, 2021, the Electric Reliability Council of Texas (ERCOT) provided GridPlus with of a notice of material breach for GridPlus’ failures to provide required collateral and timely pay settlement invoices. Between March 10,2021 and March 12, 2021, all GridPlus customers were transferred to JP Energy Resources LLC, doing business as Ampra Energy, in order to prevent those customers from being involuntarily transferred to a provider of last resort (POLR) service. On April 21,2021, ERCOT revoked all rights of GridPlus as a market participant and terminated its Standard Form Market Participant Agreement (SFA) as a result of GridPIus’ failures to provide required collateral and pay outstanding settlement invoices. Specifically, as of April 19,2021, ERCOT asserted that GridPlus had outstanding collateral calls in the amount of $1,314,595.59 and unpaid invoices in the amount of $ 1,431,642.73.
